A Louisville pet store has filed a lawsuit against city officials and Kentucky Attorney General Russell Coleman after receiving several fines for violating a Louisville ordinance aimed at shutting down "puppy mills" in the area.
Puppygram Com LLC filed a lawsuit against the Louisville Metro Government, Louisville Codes and Regulations Department officials and Attorney General Russell Coleman on Oct. 8 over the ordinance, calling it "unconstitutional." The store owners are calling for injunctive relief and a restraining order, which would prevent Louisville from enforcing the ban until further court action.
According to records provided by Louisville Metro Animal Services, animal control officers observed dogs for sale at the store on South Hurstbourne Parkway and issued five civil penalties to the business between Oct. 3-7. The violations, which carry a $500 fine, have since been turned over to Jefferson County Attorney Mike O'Connell's office, LMAS spokesperson Stephanie Jackson said.
On Monday, Judge Tracy Davis set the next appearance for 9 a.m. on Dec. 4, allowing O'Connell's office to file its own injunctive relief for ordinance enforcement, offer a response to the restraining order and give the defendants a 14-day period to respond.
Why did Louisville ban dog and cat sales?
Supporters of the ordinance hope it will prevent consumers from buying animals sourced from "puppy mills" or "kitten mills" — commercial operations that breed animals in large numbers with little regard for animals' health — but still allow private breeders and rescues to operate.
Todd Blevins, the Kentucky director for the Humane Society of the United States, previously said most stores selling dogs using a retail model "by and large, are getting them from puppy mills."
However, the business owners argue in the lawsuit they are being "unfairly discriminated against" because they do not source from puppy mills, instead working with breeders that follow state and federal regulations. The company also says it maintains health records and provides routine veterinarian treatment for its animals.
The lawsuit also alleges the ordinance is "unconstitutional" and will create a monopoly for local breeders and rescues, likely putting Puppygram out of business. By prohibiting retail of cats and dogs locally, Louisville consumers could also turn to unregulated online sellers that get their animals from "unknown" sources and put consumers at risk of scams, the lawsuit claims.
In a statement to The Courier Journal, Metro Councilman Stuart Benson, who sponsored the ordinance, said the council "worked with the Jefferson County Attorney's Office to craft an ordinance that protects animals and is constitutional."
Louisville is one of hundreds of municipalities around the country that have similar bans, including Radcliff and Elizabethtown. Some states, including California, Illinois and Maryland, have total bans.

LOUISVILLE, Ky. (WDRB) -- Audio recordings detail the moments after a plane crash in St. Matthews on Friday evening.
Three people were taken to local hospitals after a small plane crashed near Baptist Health Louisville in St. Matthews around 6 p.m. near Breckenridge Lane and Kresge Way.
Traffic lined Breckenridge Lane as the plane hit the street.
Jim Brinkman was trying to get to Home Depot, close to where the crash happened.
"Everything was basically shut down," Brinkman said. "It took us a tough time to get there."
Darrell Watson, with Louisville Regional Airport Authority, said the Piper PA 28 aircraft was on approach to land on a runway at Bowman Field when it "descended onto Breckinridge Lane and made contact with a motor vehicle on landing." The plane also took out two utility lines and some traffic lights near Baptist East Hospital.
Breckenridge Lane runs parallel to an apartment complex near Interstate 64.
"I've had a daughter and a daughter-in-law live in these apartments, so I'm very familiar with them and last night, it was unbelievable," Brinkman said.
A source close to the investigation told WDRB there was an instructor pilot and a student passenger on the plane when it experienced an engine issue while flying near the Lewis & Clark Bridge. That's when the pilot took over and attempted to get the plane back to Bowman Field.
In an audio recording, another pilot is heard saying, "the aircraft went down just over to your left. Do you see anything on the ground there?"
Audio from the plane details how Bowman Field tried to locate the crash.
"Do you know if it was on the golf course?"
"I'm not sure, it's hard to tell from here. It looked like possibly on the golf course."
Witnesses near the crash captured video of efforts to get the people injured out of harms way.
Another pilot is heard saying, "Yeah that aircraft just went down right in front of the hospital. Ambulance is at him now, looks like all the occupants are out. Emergency services are already on scene. The aircraft is wrecked, but everyone is okay."
The pilot used "extensive training and skills" to navigate the landing, but hit something before making it to the ground, the source said. The student was able to get out of the plane on their own, but the pilot had to be extracted. The pilot suffered a broken femur, but is stable. The source did not know the condition of anyone else involved.
"Our thoughts and prayers go out to the victims, and hopefully all them make it back home," Brickman said.

The building, facing East Broadway near Norton's medical campus, was used by the hospital in the past, according to Steve Wiser.
"They don't build 'em like this anymore, and this can be saved. It's a beautiful structure, it's built solidly," he recalled, pointing out gargoyles atop the stone tower that used to pelt people who passed by.
Wiser, president of the Louisville Historical Society, still has hope the building will stand. He pushed for its landmark designation over 30 years ago in the hopes it'd stay.
"The authenticity is what we're looking for here," he explained. "Not so much the fake facades. The authentic facades is what we'd like to see be saved."
It's authentically Louisville, Wiser said, because of architects Clark and Loomis. They worked on the Conrad-Caldwell house in Old Louisville, and many of the Carnegie libraries.
"And this is one of their signature churches that they designed," he added.
Its future was uncertain as the fire kept flaring up Wednesday night, flames bursting out of the church's stone tower as fire ate away at the nearby rectory.

The next afternoon, firefighters still surveyed the scene for any remaining embers. Some folks stopped to see the aftermath, with plenty visiting the night of the fire.
"As soon as we walked out the door, we smelled the smoke," Brayden Glenn remembered, making the five-block walk back to the scene of the fire with father Malik Glenn.
"This is the biggest fire me and or my daddy ever seen," Brayden said. "Because the nursing home fire, it didn't take all night. It took a couple minutes," he added, recalling a separate fire in his neighborhood they'd walked out to see.
Malik's tired of seeing the building empty. However, the current owners have been difficult to reach.
Bought under the Kentucky Medical Center Hotel name, now the secretary of state's website says the corporation is in bad standing and could have their business license revoked.
Louisville Metro Codes and Regulations records show inspectors visited the church 24 times in the last three years. Most recently, issuing violations against the owners for improperly boarding up a gate to the rear side of the building six days before the fire.
"We did have reports of one possible victim. We tried to locate the victim and get them to a med unit but they did flee the scene," Captain Donovan Sims with the Louisville Fire Department said.
The event is now fueling hope something else could move in.
"So maybe this will force the out-of-town owner to sell it," Wiser added, hinting at another historical group whose member would be interested in buying.
